Eagle Martial Group Pty Ltd ACN 647 016 082, trading as Eagle Martial Arts (EMA) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we may collect, use, disclose and otherwise handle your personal and sensitive information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your ‘Personal Information’.

WHAT IS PERSONAL INFORMATION AND WHY DO WE COLLECT IT?

Personal Information is information or an opinion that identifies an individual or can reasonably be ascertained from that information or opinion. For the purposes of this Privacy Policy, Personal Information includes some or all of the following: a member’s name, contact details, date of birth, emergency contact details, bank account and/or credit card details, student identification details, employment details, payment history and Sensitive Information.

Your Personal Information may be obtained in many ways including interviews, membership registrations, correspondence, by telephone, by email, via our website www.eaglema.com.au, or via Facebook enquires.

We collect your Personal Information for the primary purpose of providing our products, services and/or special offers to you, and for marketing purposes. EMA’s use of Personal Information also includes the following primary purposes:

  • to obtain your opinions or comments;
  • to record statistical data for marketing analysis;
  • to process and consider an application for employment;
  • to promote and market all current and future EMA businesses, venues, products and services and to inform new members about the products and services of EMA and EMA’s commercial partners;
  • to assist with EMA’s internal business processes;
  • to conduct market research and/or to improve EMA’s products and service offerings;
  • to administer contests, promotions and surveys;
  • for any other purposes that could be reasonably expected of EMA; and
  • to enable EMA to comply with its obligations under law.

Sensitive Information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us:

  • for the primary purpose for which it was obtained; or
  • with your consent; or where required or authorised by law.
THIRD PARTIES

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

DISCLOSURE OF PERSONAL INFORMATION

Your Personal Information may be disclosed in a number of circumstances including to related entities of EMA, EMA’s contractors, agents and suppliers engaged to provide products and/or perform services, commercial partners where we have agreed appropriate information sharing arrangements, EMA’s professional advisors, any other person for any other purposes that would be reasonably expected (including if required by law), or otherwise with your consent.

SECURITY OF PERSONAL INFORMATION

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

WEBSITE/ONLINE PRIVACY

EMA will handle Personal Information collected online with the utmost care, and will not knowingly use it in ways not explicitly consented to by the user who supplied the information and to whom the information refers.

EMA will handle Personal Information collected online consistently with the way that it handles Personal Information collected offline. Other matters specific to our handling of Personal Information online are set out below.

  1. a) Cookies

No Personal Information is collected by EMA when individuals visit our website, unless they chose to provide it to us (for example, by sending us emails through our website). However, we may collect certain data that does not identify individuals (sometimes called “web log information”) when they visit certain pages (such as the type of browser and operating system they have). We may also use “cookies” which are small files that are stored on computer and that manage the security and navigation process of the site. Users can choose to block these cookies but some portions of the site may not function correctly if they do. This type of data is collected for statistical purposes only, and while cookies will identify a computer, they are unlikely to identify users personally.

  1. b) Email/SMS marketing

We will not distribute our marketing material via SMS unless customers have consented to this. This is a requirement of the Spam Act 2003 (Cth). Further, customers can unsubscribe from our e-newsletter or other bulletins by using the “unsubscribe” facility contained in each electronic publication we send. Occasionally, EMA will send promotional SMS or email messages to prospective customers to market a service or activity. This will only be done on the reasonable belief that customers would be interested in the subject matter. In every case customers will be provided with clear and simple instructions on how to be removed from our mailing list.

  1. c) Hyperlinks to other websites

Our web site may contain links to other web sites which we do not control, they are not covered by our Privacy Policy. If users access other websites using the links provided, operators may collect information from users and use it in accordance with their privacy policy, which may differ from ours. We have no control over the types of information the site owners choose to collect and how they use it.

  1. d) Social Networking Acceptable Use Policy

EMA encourages all comments on any of our social networking pages (e.g. Facebook). Your opinion is important to us and we would love to hear from you. However, the social networking sites must not be used to abuse others, expose others to offensive or inappropriate content, or for any illegal purpose.

It is the user’s responsibility to protect their personal privacy when using our social networking pages. We are not responsible for the privacy practices or content of social networking pages.

INFORMATION PROVIDED BY EMPLOYEES

Any employment application provided to EMA will be used solely for the purpose of analysing suitability for a position available. Personal details will only form part of an employee record if application is successful. The information about employees will only be disclosed by EMA if required by law to authorised government agencies i.e. Australian Taxation Office or as otherwise directed by employee.

Any unsuccessful applications will remain on file to be revisited should suitable opportunities arise in the future and if required by the applicant applications may be returned or destroyed.

CCTV Cameras and Surveillance

We undertake an ongoing video recording in EMA for the purpose of ensuring security of our members via CCTV cameras, including audio recordings, and the time and date at which images are taken.

Video recordings can be accessed only by authorised staff.

Video recordings of a specific incident may be released to the Police or other law enforcement agencies only under the terms of this policy or subject to the execution of a search warrant or other legal process.
